These general terms and conditions of sale govern all relations between TOPIQ SASU, with capital of €1,000, headquartered at 23 rue de La Haye 67300 Schiltigheim, registered with the R.C.S de Strasbourg under No. 948 586 375, VAT No. FR06 948 586 375 and the customers of the www.topiq.fr website.

Prior to any transaction, the customer acknowledges having read the present terms and conditions and expressly declares his acceptance of them when he clicks on the “Validate order” button. TOPIQ reserves the right to adapt or modify these General Terms and Conditions at any time. The version of the General Terms and Conditions applicable to any transaction is the one appearing online at www.topiq.fr at the time of the order.

01 – Purpose

The purpose of these Terms and Conditions is to define the terms and conditions of sale between TOPIQ and the User. These Terms and Conditions apply to all offers and contracts relating to the sale and delivery of Products by us. In other words, you accept these Terms of Purchase when you order any Product on our website.

02 – The customer

The customer declares that he/she is a natural person of at least 18 years of age and has the legal capacity to place an order on the site. The customer guarantees that the information provided when placing an order is accurate and complete. When registering the customer’s personal data in the “my account” section, the customer must ensure the accuracy and completeness of the data required to provide the service.
In the event of an error in the recipient’s contact details, TOPIQ cannot be held responsible for the impossibility of delivering the product.

03 – The product

The products offered for sale are those described on the www.topiq.fr website. The products are offered within the limits of available stocks. TOPIQ describes and presents its products as accurately as possible. However, if errors or omissions appear on the site, the customer acknowledges and accepts that TOPIQ cannot be held responsible.

04 – Prices

Product prices are indicated in Euros, all taxes included, excluding shipping costs. They include VAT and any reductions applicable on the date of the order. The total price of the order (all taxes and shipping costs included) is indicated in the shopping basket. Delivery charges will be indicated on the order form before the order is confirmed. Prices shown are subject to visible error. If an incorrect price is displayed, for whatever reason, the order – even if validated – will be cancelled. The customer will then be able to place the order again at the corrected and exact price, if he so wishes. TOPIQ reserves the right to modify its prices at any time.

05 – Ordering

To place an order, the customer must identify himself with his e-mail address and password. For all first-time orders, customers must follow the account creation procedure indicated on the www.topiq.fr website. Before confirming their order, customers will have the opportunity to check the details of their order and its total price, and to correct any errors, before confirming their acceptance. Any order implies acceptance of the prices and descriptions of the products available for sale, as well as of the General Terms and Conditions. If products are unavailable, TOPIQ will inform the customer by e-mail as soon as possible. The customer will then be able to cancel his order and to be refunded, if necessary, the sums already paid. The TOPIQ company reserves the right to block the order, in particular in cases of non-payment, erroneous address or an order of a customer with whom would exist a litigation or an incident relating to the payment of a former order or which would agree with the provisions of the present general conditions of sale.

The TOPIQ company will inform by e-mail, the customer. In defect for the customer to proceed near company TOPIQ to the correction of the erroneous elements or contrary to the present general conditions of sale, company TOPIQ reserves the right not to treat the order. An email of confirmation recapitulating the order will be addressed by company TOPIQ. For this purpose, the customer formally accepts the use of the electronic mail by company TOPIQ of the contents of its order. An invoice will be given at the time of the delivery. The TOPIQ company reserves the right to do it in electronic form.

06 – Payment terms

Products are payable in full on the day the order is placed. Payment is made by credit card on a secure server. We accept the following payment methods on our website: Credit Card and PayPal. The data recorded and stored by TOPIQ constitutes proof of the order and all transactions. The data recorded by the payment system constitutes proof of financial transactions.

07 – Delivery

TOPIQ delivers worldwide. Orders are registered, processed as soon as they are received and shipped within an average of 3 working days by the Colissimo service of the French postal service, to the delivery address given by the purchaser at the time of ordering. Delivery times are given as an indication only. Simply exceeding a delivery time does not entitle you to compensation. TOPIQ cannot be held responsible for the consequences of a delay in delivery for which it is not responsible. In the event of damaged packages (already opened, missing product(s)), the customer must notify the carrier and the TOPIQ company, by all means, of any reservations within 3 days of receipt of the product.

08 – Right of withdrawal

All products delivered in Europe are subject to a 15-day withdrawal period from the date of receipt of the products, without giving any reason. The customer may return the products, which must be intact, complete, originally packaged and accompanied by the order number, at his or her own expense, to the following address:TOPIQ23 rue de la Haye67300 Schiltigheim TOPIQ will reimburse the customer for the returned products, subject to compliance with the above-mentioned conditions, less any shipping costs, within 15 days.

09 – Exchange

TOPIQ offers the possibility of exchanging a product for another of the same price under certain conditions, at our sole discretion, also within 15 days. The exchange is always subject to stock availability. The original Product must be returned in accordance with our return policy set out in article 8.We will not charge delivery fees on the new “exchange” order. The customer may return the original product at his own expense via a La Poste service.

10 – Liability

TOPIQ has an obligation of result. However, TOPIQ cannot be held responsible if the non-execution of its obligation is attributable either to the unforeseeable and insurmountable act of a third party to the contract, or to a case of force majeure as defined by French case law. Similarly, TOPIQ cannot be held liable for any inconvenience or damage inherent in the use of the Internet.

Personal data will be processed electronically when the order is placed. The customer is invited to refer to the legal notice and RGPD section of the www.topiq.fr website for all information relating to this point.

12 – Applicable law

The general terms and conditions of sale are governed by French law. The competent court in the event of litigation will be that of Strasbourg.
